Please read these terms carefully before using RoamFit

1. Agreement to Terms

By accessing or using RoamFit ("Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service. These Terms apply to all visitors, users, vendors, and others who access or use the Service.

2. Description of Service

RoamFit is an online directory platform that connects users with fitness facilities, personal trainers, and wellness service providers across Thailand. The Service allows users to discover, compare, and contact fitness-related businesses, and enables fitness professionals to create and manage business listings.

3. Eligibility

You must be at least 18 years old to use this Service. By using RoamFit, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You will not use the Service for any illegal or unauthorized purpose
  • Your use of the Service will not violate any applicable law or regulation

4. User Accounts

4.1 Account Creation

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason we deem appropriate.

5. Vendor Listings and Content

5.1 Listing Creation

Vendors who create business listings agree to:

  • Provide accurate and truthful information about their business
  • Own or have appropriate rights to all content uploaded (photos, descriptions, etc.)
  • Maintain up-to-date contact information and business hours
  • Respond to user inquiries in a professional and timely manner
  • Comply with all applicable laws, regulations, and professional standards

5.2 Content Standards

All content posted on RoamFit must not:

  • Be false, misleading, or deceptive
  • Infringe upon intellectual property rights of others
  • Contain defamatory, obscene, or offensive material
  • Include spam, advertising, or promotional content unrelated to the listing
  • Contain viruses, malware, or other harmful code
  • Violate any local, state, national, or international law

5.3 Verification and Claims

We may verify business ownership before approving listing claims. We reserve the right to request additional documentation to confirm legitimacy. False claims or fraudulent verification attempts will result in immediate account termination.

6. Intellectual Property Rights

6.1 Our Rights

The Service and its original content (excluding user-generated content), features, and functionality are owned by RoamFit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 User Content License

By posting content on RoamFit, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform that content in connection with the Service. This license continues even if you stop using the Service.

6.3 Trademarks

RoamFit and its logos are trademarks of RoamFit. You may not use these trademarks without our prior written permission.

7. Prohibited Uses

You agree not to use the Service:

  • In any way that violates applicable laws or regulations
  • To transmit or procure sending of advertising or promotional material without our consent
  • To impersonate or attempt to impersonate another person or entity
  • To engage in any conduct that restricts or inhibits anyone's use of the Service
  • To use any robot, spider, or other automatic device to access the Service
  • To introduce viruses, trojan horses, or other malicious code
  • To attempt to gain unauthorized access to any portion of the Service
  • To harass, abuse, or harm another person
  • To collect or track personal information of others without consent

8. User-Generated Content and Moderation

We reserve the right (but not the obligation) to:

  • Monitor, edit, or remove any user content for any reason
  • Terminate accounts that violate these Terms
  • Cooperate with law enforcement authorities regarding illegal activities

We do not endorse or guarantee the accuracy of any user-generated content and are not responsible for transactions between users and vendors.

9. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by RoamFit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party content or services.

10. Payment Terms

10.1 Premium Features

Certain features of the Service may require payment. All fees are quoted in the applicable currency and are non-refundable unless otherwise stated.

10.2 Billing

By providing payment information, you authorize us to charge the applicable fees to your payment method. You are responsible for providing accurate billing information and updating it as necessary.

10.3 Refund Policy

Refunds for subscription fees are provided at our sole discretion and only in accordance with applicable law.

11. Disclaimers and Limitation of Liability

11.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 No Warranty

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • The quality of any products, services, or information obtained through the Service will meet your expectations
  • Any errors in the Service will be corrected

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROAMFIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify, defend, and hold harmless RoamFit and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Bangkok, Thailand.

14. Dispute Resolution

In the event of a dispute, you agree to first attempt to resolve it through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue formal dispute resolution.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before new terms take effect. What constitutes a material change will be determined at our sole discretion. By continuing to use the Service after revisions become effective, you agree to be bound by the revised Terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

17. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

18. Entire Agreement

These Terms constitute the entire agreement between you and RoamFit regarding your use of the Service and supersede all prior agreements and understandings.
